This comment is respectfully submitted by Nancy Beaton, Tsawwassen (Delta), BC and Jennifer Urquhart, Point Roberts, WA. We are representatives of the Cross Border Coalition to Stop the Radio Towers.
For 12 months we have canvassed Provincial, State and Canadian and American Federal authorities to help stop the proposal to build 5 AM broadcasting towers in Point Roberts based on (1) misleading and misrepresented information with regard to Canadian population numbers in BBC Broadcasting Inc.’s (BBC) application to the US Federal Communications Commission (FCC) to relocate their existing Ferndale, WA, radio towers to Point Roberts, WA, allowing Sher-E-Punjab, the lessee, to reach more listeners in Canada; and (2) the evidence that Sher-E-Punjab/KRPI are broadcasting from the USA into Canada without a Canadian license under the shell of BBC that hold the US license for AM1550.
We have attached information which provides evidence that BBC's application to the FCC contains misleading and misinformation:
1. A copy of the Point Roberts Taxpayers Association Formal Petition to the FCC to deny BBC's license renewal to operate KRPI;
2. A copy of an Informal Objection by Arthur Reber, PHD (coalition member) to BBC's license renewal showing that BBC Broadcasting is a shell company established for Sher-E-Punjab Radio of Richmond, BC Canada as a way to evade Canadian broadcast laws. This document also outlines how all decisions with respect to programming and corporate matters are managed in Canada and not the USA--a direct violation of the FCC's alien ownership and control of their FCC license. Further, it appears Sher-E-Punjab’s (and its related companies) years of unlicensed broadcasting into Canada have benefitted them (enough to afford a new tower array with a stronger signal), most likely at the cost of other stations which have CRTC approval.
It seems clear that Sher-E-Punjab is operating in violation of the regulatory guidelines of both the FCC and the CRTC. It is for the reasons provided above and in the attached material that a mandatory cease and desist order by the CRTC would be justified to Sher-E-Punjab for their broadcast operation at Richmond, BC (or elsewhere in Canada) as per the Broadcasting Act.
Finally, we attach a document from the Washington Secretary of State Corporations Division (3) which shows the make-up of the board of directors of a related company, BBC Holdings, Inc., which holds title to the land beneath the present KRPI towers in Ferndale, WA, and a document from the FCC files (4) indicating positional interest in BBC Broadcasting, Inc. They are an indication how interrelated the various companies are which have been formed to serve Sher-E-Punjab’s broadcast activities. All three companies, Sher-E-Punjab, BBC Broadcasting, and BBC Holdings are controlled by the same group of related individuals and created, we believe, to shield Sher-E-Punjab from the broadcast laws of both Canada and the US.
On behalf of the Coalition, we would ask the CRTC to immediately impose a cease and desist order on Sher-E-Punjab. While we will not be able to attend the hearing in Gatineau, if it were moved to Vancouver, we would have representatives attend.
