RE: Broadcasting Notice of Consultation CRTC 2011-668 Call for comments on an amendment to the Commission’s buy-through requirement.

Dear M. Morin:
We provide these comments to the Commission for consideration in re-examining the buy-through requirement. These ethnic services – Telelatino, Odyssey, Talentvision, Fairchild and Asian TV Network are now Category A services. With this upgrade these services have mandatory access to the BDU systems and control market pricing and packaging. These Category A services have been in the system for more than 16 years, having substantial market share and are not need of more protection from Category B services as stated in decision CRTC 2011-455 in amending the BDR subsection 27 (4), however we agree for the need of protection from foreign services.
Regulations Amending the Broadcasting Distribution Regulations
AMENDMENT
1. Subsection 27(4) of the Broadcasting Distribution Regulations[1] is replaced by the following:
(4) Except as otherwise provided under a condition of its licence, a licensee that distributes a general interest non-Canadian third-language service or a general interest Category B third-language service to subscribers shall also distribute an ethnic Category A service to them if one is available in the same principal language.
We strongly believe the buy-through requirement should be changed to reflect current Canadian marketplace as suggested below and as attended in PN 2008-100. This is fair, allows for all Canadian based services to grow, more local voice, programming and protection against foreign competition.

We strongly believe the Category B services are no threat to Category A services with them having substantial market share, being in the system for over 16 years and additional protection is not required.
